Luxury Home Marketing Group August Focus: Consumer Protection Rules and the Luxury Home Market

(Raleigh) – Raleigh’s Luxury Home Marketing Group focused on upcoming rules changes which may affect home buyers and sellers, starting this October.

“The Consumer Finance Protection Bureau (CFPB) has a series of new rules for homebuyers and sellers, beginning this fall,” said LHMG President Jill Rekuc. “We share information about regulation changes like this as part of our ongoing education among our membership. It’s one of the advantages we deliver to our clients, via the Luxury Home Marketing Group.”

Denise Beatty of Towne Mortgage of the Carolinas (NMLS#51213) outlined the details of the proposed changes. She briefed members on the rules, and indicated that while they were new regulations, they were unlikely to cause closing delays. The members discussed how important it is to have a close relationship with their staff and closing attorneys to ensure a smooth closing process.

These new integrated mortgage disclosures are all in an effort to help the consumer “Know before they Owe.” These new changes may increase the amount of time necessary to close residential real estate transactions.

The Raleigh-based Luxury Home Marketing Group focused on homes in North Raleigh during their April gathering.

“This area of Wake County includes some of the most prestigious neighborhoods in our market,” said LHMG President Jill Rekuc. “Our meeting and tour focused on homes north of I-540, including the neighborhoods of The Moorlands, Crossmoor, Swan’s Mill, Devon and Wakefield. These communities are among the most dynamic in the Estate Home Marketplace, with increased interest & activity in home sales.”

LHMG Past President Linda Craft shared details of a luxury broker she shadowed in Austin Texas. Board members compared and contrasted methods used by a group similar to the Luxury Home Marketing Group.

The board reviewed a presentation by Denise Beatty of Towne Mortgage of the Carolinas (NMLS#512138), of an extended rate lock program to assist borrowers in securing a rate. “This is an ideal program for buyers who are building a new home,” said Beatty. “The program allows a rate-lock for up to 6 or 12 months and a float-down if the market warrants.”

Additionally, board members were proud to support a fundraiser for ALS (Amyotrophic lateral sclerosis), hosted by board member Kathy Beacham’s daughter, Shae.

Luxury Home Marketing Group Monthly Focus: Protecting Homeowners from New Tax Threat

The Raleigh-based Luxury Home Marketing Group joined forces with the North Carolina Association of Realtors to head off legislation that could have cost the most vulnerable homeowner higher taxes at the time they could afford it least. The ‘Mortgage Cancellation Tax’ provision of the proposed legislation (SB 20/HB 40) would have forced homeowners to pay 5.75% state income tax on cancelled mortgage debt, as if it was cash, even though the homeowner would never have taken the money in cash.

“Our organization focuses on helping an elite segment of the marketplace make the most of their home buying and home selling experience,” said LHMG President Jill Rekuc. “However, this issue had the potential to cost every kind of homeowner thousands of dollars that they didn’t owe. Our members joined with the NCAR to encourage lawmakers that this was a bad move for North Carolina families.”

Lawmakers listened to industry representatives and removed the provision from the bill. However, the Luxury Home Marketing Group will continue to monitor this important issue with other North Carolina Realtors. Read more about this bill at the NCAR website.
